"The Limits of International Law" argues that International Law matters but that its scope and significance is far less than assumed by academics, the media, and many public officials. Adopting a rational choice framework, the authors show that International Law is a term that we use to refer to variously circumscribed cases of international cooperation. States are able to cooperate through International Law but only under narrow conditions; much of International Law merely ratifies existing relationships, and has no independent normative force. Indeed, recent efforts to replace international politics with law and judicial process rests on a misunderstanding of the past accomplishments of International Law. "The Limits of International Law" will have important implications for debates about the role of International Law in the foreign policy of the United States and other nations.
The first edition of this textbook was published in 2016, but since then the legal and factual scenario of European cross-border insolvency law has changed dramatically. In particular, three main events have occurred. First of all, the prescriptions of Regulation (EU) 2015/848 (Recast) have become applicable; second, the UK has left the European Union, without this completely reducing the meaning of the regulation for the UK though; and third, the European Union has enacted Directive (EU) 2019/1023 on preventive restructuring and insolvency.
Moreover, since 2016, the Court of Justice of the European Union (CJEU) has delivered significant new judgments, albeit regarding the Regulation (EU) 1346/2000; national courts have started applying the prescriptions of Regulation (EU) 2015/848; scholars have produced numerous papers and commentaries on Regulation (EU) 2015/848; and the United Nations Commission on International Trade Law (UNCITRAL) has issued relevant new documents such as the 2018 'Model Law on Recognition and Enforcement of Insolvency-Related Judgments' and the 2019 'Model Law on Enterprise Group Insolvency'.
The second edition of this textbook maintains its original purpose of providing readers with a user-friendly framework so that they may understand the rationale of Regulation (EU) 2015/848 and be consistent in their application of its prescriptions. However, in order to analyse the impact of the new events and discuss the most recent interpretations of judges and scholars, each chapter has been given new bibliographical references, supplemented with further observations, and, in some cases, even reorganised.
Examining issues of power, gender, and religion in the ancient world, Perpetua's Journey: Faith, Gender, and Power in the Roman Empire is a graphic history set in Roman Africa in 203 CE that tells the story of the Christian martyr Perpetua.
The Passio Sanctarum Perpetuae et Felicitatis, also known as The Passion of Saints Perpetua and Felicity, is the first extant diary authored by a Christian woman. Vibia Perpetua was a young mother who lived in Roman Africa and, at the age of twenty-two, chose to publicly proclaim her Christian faith. She died as a result of her actions, though she did not die alone; she was part of a group of Christian martyrs, including several slaves, who were placed in prison and then executed in Carthage during the birthday celebrations of Emperor Septimius Severus's son in 203 CE. Perpetua's diary contains her account of the days leading up to her martyrdom.
Perpetua's Journey occupies a space between the many works designed primarily for specialists and advanced scholars, who already know a great deal about Perpetua and the history of the Roman Empire, and lives of saints that are intended for general readers. Perpetua's Journey is unique because it combines both sequential art and historical and social commentary, and it places Perpetua's diary in the context of life in Roman North Africa in 203 CE.
Ramon Jose Sender Graces was born on 3rd February 1901. He was a prolific writer, who published a vast quantity of novels, stories, plays, essays, poetry and articles throughout his life. He wrote Requiem por un campesino espanol during one week in 1952, with the intention that it be part of a collection of short stories. That book never materialised, but Sender's novella was published by Aquelarre in Mexico in 1953 under the title Mosen Millan . The title was changed in 1960 by New York publisher Las Americas to something that could be meaningfully translated into English. The political message conveyed within the book meant that it was not published in Spain until 1974. Requiem for a Spanish Peasant relates the thoughts and memories of Mosen Millan, the parish priest, as he sits in the vestry of the church in a nameless Aragonese village, preparing to conduct a Reqiuem Mass to celebrate the life of a young peasant, Paco el del Molino, killed by the Nationalist army a year earlier, at the outbreak of the Spanish Civil War. As he waits, his thoughts are interrupted by the occasional comings and goings of an altar boy, who hums to himself an anonymous ballad. This ballad, along with Millan's thoughts and the voice of an omniscient narrator, creates three strands of narration for the reader to follow.
